    What I find most interesting is that fact the Creative is joining the Made for iPod program and will be producing its own iPod accessories.

    Really? Honestly, this is the most uninteresting Apple product since the Performa series in my opinion. Yawn. Not compelling. The SJ RDF will probably help my opinion, but still. My phone works. Thats all I need. (gah, am I getting old?!?!)

    Yes, you're sounding very old. It's not the form factor. It's the software. Your phone's software sucks. All phones software is horrible. It's the same with the PC market. The whole integration is horrible. Apple streamlines processes with their software and they happen to understand good physical design and style. You're just not going to see many companies like that in what's left of your lifetime.

    I heard I think here at macrumors that Sony's mp3/phone is selling like hotcakes and I think they branded it as a walkman/cell phone.

    What I hope is that the iPhone will be on Cingular, since my entire family and most of my friends are on it. I'd pass on the phone if they do one of those new deals where you're piggy-backing on other networks like Alltel (alltell, altell??) or it's on another carrier.

    i can buy an itunes phone right now from cingular but i dont want one
    what makes them think i will buy one now because its from apple and not motorola

    their amazing design and interface...the reason why people buy all their other stuff. not to mention the sexy idea of ichat mobile

    What's hard in the U.S. is that most people make a modest or poor salary--yet the culture is very materialistic and there is a lot of pressure to buy so many luxury goods and services. At least in third world countries, your friends aren't pressuring you to take extravagant vacations you can't afford or go out to expensive restaurants.

    I don't know...with five lawsuits between the companies, I wouldn't be surprised if the litigation would have cost at least $100 million. But I do think Apple wasn't terribly confident...

    Edit: The estimates I've seen say that a typical patent infringement case costs up to $5 million per side. This would probably be higher than a typical case, with $100 million in total not out of the question.

    If apple paid 100 million, they should then sue their lawyers for fraud. This suit would not even come close to 100 million.

    Right. You won't get the full 64 bit native benfits of Leopard without either a G5 or a Core 2 Duo processor.

    It'll still run on a G4 just fine.

    Yea thanks, I really have no idea what 64-bit and 32-bit is about...all I know is that Core Duo didn't support it...

    Now I'm buying a new mac soon- thinking of going with 17inch iMac. Will a 128MB video card be enough for Vista to run perfectly? I want as many features as possible...

    Wow, the dual screen output is what could some day push me over the edge. A 27" display + 2 27" Apple screens either side sounds pretty nice. Still not enough to make me part with my 30" ACD right now though.

    You do realize you can do almost the same thing (not sure about resolutions) with USB2 displaylink adapters?

    My lowly 2007 Santa Rosa MBP can handle this fine with one 22" monitor using the old EVGA UVPlus... I even run it over a hub that also does keyboard, mouse and iphone cradle. Slight delay, no stutter, nothing. videos play fine (never tried full screen, but it's my work computer, so no need for that).

    ... and yet there is a conspicuous lack of a self-congratulatory press release from Amazon about their sales numbers. I suspect that despite Unbox starting with 2000 movies, they've sold less than 125,000 movies.

    Unibox may not have SOLD that many but how many did they rent? Dollar figure and units.

    I keep saying Apple is making a mistake by not offering rentals.

    As has been mentioned the typical patent litigation is in the $5-$10 M range paid to the attorneys. With the main lawsuit and 5 countersuits they could have made a big dent in that $100M. Even when you have a large legal staff, litigation is usually handled by outside firms that specialize in those kinds of trials. With 32 million iPods sold in 2005 even a $3 licensing fee (~1% on average is not an atypical licensing fee) you'd easily surpass $100M if you were planning to sell iPods for more than 1 more year. A lump sum is preferable.

    There are also less obvious or tangible costs. Uncertainty is never good buyers may shy away from a purchase if they feel there is a potential that the product will soon be abandoned/unavailable. There's also the fact that the discovery process in such lawsuits is often used as a tool to try and pry information out from the other side, such as future product plans, etc. that might well be worth big $ keeping undr wraps. And last but not least is the distraction that such a suit tends to place on the key employees who may be involved in designing a workaround or simply being deposed and directly involved with the trial.

    True, but let's put it this way: Apple didn't settle for $100 million because winning would have cost them as much as 10% of that sum. Remember, Apple was going up against a much smaller company with far less in the way of resources. If Apple could have ground Creative down over years of protracted litigation with some assurance of getting a better deal, then I have little doubt that they probably would have done so. I suspect Apple saw a RIM-like situation, where they were unlikely to prevail in court and in the meantime the litigation environment would create opportunities for competitors.

    Well if they were already make some accessories for the ipod they might actually be tempted to make one or two products sound cards for apple. What I would love to see is Creative licensing their X-FI audo tech to apple to put in the ipod. I have been hearing nothing but good things about X-Fi.

    That would be way behind everyone else, and also would prevent students from taking advantage of the free iPod Nano with a new computer. Also, if they want to catch the student market (like me) they need to update tomorrow, or at least on September 5. The shipments from asia are probably the best indicator of a release that we have seen to date. Apple would not leave "secret" massive shipments lying around unsold. There are over 150 Apple Stores worldwide, and there is no way there wont be some sort of security breach if hundreds of thousands of boxes are sitting around all around the world. I personally would probably find a way into the nearest Apple Store storage room to see what is in those boxes, though I proably wouldn't have to because an apple employee would blab first.

    Only on UNOPENED product. If you've opened it, you gotta pony up 10% restocking fee, if you bought from apple. They will refund money if there is a price drop in that timeframe, though.

    o *****.... i knew for a fact that there was gonna be some sort of catch!!

    but 10% restocking fee??? isn't that a bit too much?

    so what do you think, is new ipod literally worth procuring with the sacrifice of 10% restocking fee, when the only difference is the brighter screen, 1.5 more hr of video play time, search function, ....etc??

    Seriously though...I think it is fair to say we all have good and bad stories about carriers. All carriers.
    But read the release.
    They are using Cingular for just 6 months then offering it to everyone (who wants to take it)
    This is a wise decision on a brand new product for lots of obvious reasons.
    I personally use Cingular but have my issues with them and all the rest for that matter. (don't waste your $$$ on their lame insurance plan for instance)
    Also it would seem that this will not be a US only product.

    I know it is hard to be patient with these things....damn it I am frustrated at having to wait 2 weeks for my wireless keyboard and 2 months for my Shuffle.
    BUT as they say and the truth is.....ALL good things come to those who wait.

    I think many of you have missed the simple significance of this news.
    At last the phone is real...it is coming soon. No more rumors:D

    This is why I would make such horrible paparazzi... I don't recognize either one of them in that picture. I'd walk into the Apple store and be elbowing them both aside trying to get a look at the gadgets on the counter. That is until I got drawn and quartered by their two entourages pulling me in different directions arguing over who got to teach me a little respect first...

    That's quite a sum of money! A bit more than my Power Mac cost me, even with that extra RAM.

    It's seems to me that it's unlikely that the cost of litigation could have exceeded the cost of a settlement, so does that show that Apple expected to be found liable for patent infringement as charged?

    You seem to be unfamiliar with our court system. This case could have dragged on for YEARS, and cost Apple a TON of money--possibly far more than 100 Million.
